Resolution Following Tragic Car Crash

Atlee Hall recently resolved a tragic case involving a car crash that resulted in the death of an elderly couple.

Our clients’ parents were driving along when a driver on the other side of the road experienced a medical emergency. His vehicle crossed the center line and crashed into their vehicle head-on. Our clients’ parents both died as a result of injuries sustained during the crash.

The claims were able to be resolved for all of the available insurance coverage, despite the other driver’s insurer initially claiming that the sudden medical emergency doctrine was a complete defense. That doctrine often involves a vehicle operator who suddenly and unexpectedly suffers a debilitating medical condition such as a heart attack, stroke, or sudden loss of consciousness.

Atlee Hall was able to convince the insurer that the defense did not apply in this case based upon surveillance footage and statements made by the investigating police officer, as well as eyewitness testimony. Not long after submitting a comprehensive demand package to the driver’s insurer, which addressed all of the potential legal and factual issues, the case was brought to a successful resolution.
